Terms & Conditions of Trade

1. Selwyn Grove: We endeavor to supply all plants true to name and description, but cannot give warranty expressed or implied as to their growth, description or performance.

2 Terms:

(a) Full payment must accompany this order unless a credit arrangement has been made with Selwyn Grove.

(b) Where such an arrangement has been made, the terms of payment are net cash on the 20th of the month following delivery.

(c) Selwyn Grove reserves the right to charge Interest on all overdue accounts at the rate of 24% per annum (2 % per month); and

(d) All prices include GST.

(e) Freight is not included in our prices and must be included in your cheque that accompanies your order.

3 Delivery: All plants become the responsibility of the purchaser from the time of sale or when placed on any form of transport.

4 Risk and Title:

(a) The risk in the goods supplied by Selwyn Grove to the buyer shall pass to the buyer upon delivery but the ownership in them shall not pass to the buyer until the buyer has paid for the same and discharged all outstanding indebtedness to Selwyn Grove whatsoever.

(b) Until payment in full of such indebtedness has been made, the buyer acknowledges and agrees as follows:

That the buyer hereby irrevocably gives Selwyn Grove, it's agents and servants, leave and license without the necessity of giving any notice to enter on and into any premises occupied by the buyer and to enter on or into any Premises where the goods are stored or planted to search for and remove any of the goods supplied to or in which Selwyn Grove has ownership as aforesaid without in any way being liable to the buyer or any person or Company claiming through the buyer.

5 Limitation of Selwyn Grove's Liability: In the event of any dispute arising out of this agreement by Selwyn Grove the remedies of the buyer shall be limited to damages. Under no circumstances shall the liability of Selwyn Grove exceed the price of the goods.
